Fleming absolved of mischief

Doug Fleming agreed to a crown attorney's proposal to plead guilty of mischief and, with Judge David Harris's agreement, he received an absolute discharge.

Even though the Ontario Superior Court of Justice judge found him guilty, he did not receive a criminal record.

Fleming said the proposal was made at a pre-hearing for his charge stemming from using his truck to block Argyle Street South in Caledonia on Dec. 1, 2007. The 20-minute incident occurred during a protest against a smoke shop at that end of the street.

He accepted the deal because it gave him the opportunity to explain that his action was part of a protest against an illegal activity not yet addressed by the police. Before he did so, a person from Six Nations had already blocked the street.

In an interview, Fleming said protesters were trying to convince police to do their job related to the smoke shop. He pointed out that Six Nations protesters blocked the Highway 6 bypass for four days in April to persuade police to refrain from doing their job in the Mohawk community of Tyendinaga in eastern Ontario.
