I am a police officer with the Hamilton Police Service and have been so employed since the 2^nd day of November 1999; I am currently assigned to the Division 3 Criminal Investigations Division operating out of Mountain Station 30. This statement of fact is written in regards to the occurrence in the area of my personal residence while I was in an off duty capacity.

At approximately 2130 to 2230 hrs or thereabouts while in my residence my attention was drawn to a large number of off road vehicles being highly revved and a great amount of raised voices. I exited my residence to see what was going on and observed 3 area residents seated on the concrete blocks at the end of the court on Braemar Avenue (approximately 100 yards away from my door). The 3 males were seated and smoking cigarettes while approximately 40-50 natives ranging in age from late teens to mid forties began to surround them and yelling obscenities at them. I approached the area in an effort to find out what was going on and protect the well being of the area residents.

Once at the area of contention which is approximately 50 feet North of the illegally occupied area I too was surrounded by the native contingent (both males and females). I asked a female native what the issue was at which time a male native approximately 35-40 years, (S1) approached one of the area residents whom I do not know and stated in a loud aggressive voice “you got no business here fucking leave or I will knock you dead right now”.

The resident stated in a quiet normal tone of voice “I am not doing anything man what is going on”, he remained seated with his hands in his jacket pockets. Suspect 1 then grabbed him by the throat with his left hand and struck him in the left side of his face with a closed fist, his then attempted to throw the resident onto the ground. I stepped in to pull the male out of the group of native males that were now surrounding him and pushing him around at which time a male native (S2) approximately 20-25 years, attacked me from my rear and to my left, the punch thrown by this native missed connecting but was followed immediately by a double hand push attempting to topple me towards the crowd of natives. I was immediately struck from the front by another male native (S3) approximately 35 yrs, as I looked towards this attack the male pulled a hand held contact taser and engaged the trigger causing the prohibited weapon to spark. Suspect 3 then lunged towards me with the weapon as I backed up. Natives began putting their masks on and several bats and boards with nails were brandished in a threatening manner.

I was then grabbed from behind by a couple of area residents who had just arrived on scene and pulled me and the other residents out of the encircling natives. As we moved back towards the mouth of the court the native group advanced onto the street encouraging residents to fight with them and stating “your fucking next, your all gone or dead”.

The natives then began to withdraw as more area residents came out of their homes and created a line of defence, the natives then backed onto the field area and got into their vehicles. At this time members of the O.P.P. arrived and advanced towards the concrete blocks which encircle the end of Braemar Avenue. The natives pulled their vehicles back into the field and remained for approximately 30 minutes howling and throwing insults and challenges towards the O.P.P. officers and residents in the area.

The main contingent moved away and back towards the Argyle Street area however approximately 10-15 natives remained in the field in the dark; they were only observed when another approaching ATV silhouetted them with its headlights.

                  Short dark hair, goatee

                  Baseball cap (dark)

                  Maroon and Grey lumber style jacket

                  Dirty blue jeans

Suspect 2- Male Native 20-25 yrs old

                  Approximately 5’10”

                  Approximately 160 -175 lbs

                  Dark hair cut very short on sides, low Mohawk from forehead to neck

                  Goatee (sparse) and appeared lighter than his hair

                  Grey t-shirt with some type of logo on the front

                  Blue jeans

Suspect 3- Male Native 30-40 yrs old

                  Approximately 5’9”

                  Approximately 250-275 lbs

                  Dark long hair pulled back into a pony tail

                  Dark full goatee

                  Black shirt with Mohawk Warriors logo emblazoned on the front

                  Dark pants

                  Held contact taser in left hand 

I did not consent to any contact between myself and the Natives who assaulted me nor did any area resident that I observed. I will fully support all charges laid in this and any other matter of which I am involved. I do not wish to make a victim impact statement and suffered no injury during this confrontation. I am however extremely frustrated and disgusted by the ongoing lawlessness and lack of decisive action.
