Ontario Paralyzed Police Commissioner

Gwen M. Boniface

Is Gwen Boniface biased against non-Natives?

According to the OPP website Gwen Boniface is a member of the First Nation Chiefs of Police and also received Order of Ontario in 2001 for her work with First Nations communities.

Is it acceptable to raise questions about possible bias as we review what is happening under her leadership?

Facts to Consider:

OPP officers assigned to the native standoff in Caledonia say their bosses have put their public image ahead of officer safety and law and order. (Link)

`It's okay to have an officer walking around in tactical uniform at Wasaga Beach on a long weekend, but it's not okay in Caledonia' Karl Walsh, president of Ontario Provincial Police Association.

...the president of the union representing 7,500 OPP officers says the Caledonia standoff indicates there's one law for aboriginal people and another for everyone else in the province. "Our concern is basically that there is a two-tier justice system," Karl Walsh, president of the Ontario Provincial Police Association. (Toronto Sun)

OPP Commissioner Gwen M. Boniface has a Class Action Lawsuit against her for misfeasance in a public office and for negligence; (Legal Papers) The lawsuit further states that Gwen Boniface acquiesced in a commitment by the Minister of Aboriginal Affairs for Ontario not to prosecute the protestors for any criminal offences in violation of Section 41 of Police Service Act.

Ed McCarthy, a Hagersville lawyer representing the Haldimand Law Association, says concern for the rule of law runs very deep. "It's been fundamentally violated in Caledonia, and this is why the judge has called this hearing," he said. McCarthy said the apparent suspension of the rule of law is evident not only in the OPP's non-enforcement of the injunctions, but in their non-enforcement of various sections of the Criminal Code since then. "The fact that they have allowed these people to take over the subdivision, occupy the houses, set fires, do all sorts of things, intimidate people -- it appears they've been told to take a hands-off attitude toward anything that the natives do," McCarthy said. "You can't draw any other conclusion from it." (more info)

Haldimand Law Association: "A fundamental characteristic of any democratic civilization is the governance of the Rule of Law. When the Rule of Law comes under attack so do the rights and freedoms of every individual in that society. The Rule of Law is under attack in Haldimand County and the powers that be, that have been entrusted to ensure the operation of the Rule of Law and to protect the rights and freedoms of the residents of Canada, are either refusing or neglecting to act. " [Link]

As you review this website you will see that thousands of possible criminal charges against the Natives have not been filed - Why? The answer always is that we are still investigating the crimes. However, see how quick the OPP are able to file charges on Friday, June 9, with respect to the assault of the elderly couple, media personal and the attempted murder of an OPP officer occurred. Why did it not take months to investigate these alledged crimes? Could it be that the OPP was able to file criminal charges quickly since the main stream media in Toronto are suddenly covering the story?

Furthermore, just how long does it take to arrest someone at the scene of the crime? If someone is robbing a bank while the police are there, can they not just arrest the bank robbers because they personally witnessed it? Of course they can. We see it everyone day in the news that people are arrested immidiately at the scene of the crime - Just not Natives at the scene of crimes in Caledonia.

It appears that when elderly people are being attacked the OPP must start an investigation which will last a few months before coming to the aid of these people. We just hope, we the people, can hold off our attackers until the OPP investigation is done.

Will we ever see these thousands of criminal charges laid?

Three clear Questions for Gwen Boniface:

1) Why cannot OPP Officers arrest Native People who are attacking and even beating people immediately?

2) What assurance can you give people of Ontario where there are 65 other Native land claims that their small town will be protected - both their property and their person?

3) Is the spokesperson for the union lying to us that OPP Officers' bosses have created (by your actions - not written rules) one set of rules for Natives and another for non-Natives?

Gwen M. Boniface must be fired immediately.
