OPP disobeys Supreme Court of Canada

Dec 30, 2006

We have all witnessed the OPP's outright defiance of Judge Marshall's court order. We have witnessed how the OPP refuse to enforce the Criminal Code of Canada. We have watched as the OPP allow Native Flags to be put up while arresting non-Natives for trying to put up Canadian Flags.

We have even seen the OPP violate the Criminal Code by keeping me overnight in jail without a charge. When the police force is willing to commit criminal acts to stop average people from raising a Canadian Flag then you know just how far the police force has fallen.

Now we see that the OPP is directly disobeying the Supreme Court of Canada. In a ruling in 1993, Ramsden v. City of Peterborough, the Court ruled that placing objects on Hydro Poles was a Right guaranteed under the Charter of Rights & Freedoms. [Link to Ruling] They ruled that objects placed on Hydro Poles was Free Expression and local by-laws could not stop people from placing objects on Hydro Poles.

The courts agreed with the argument that stopping someone from placing objects on Hydro Poles infringes on a person's guaranteed freedom of expression under s. 2(b) of the Charter. The Government agrued that they had the right to stop people because of public safety, traffic safety and workers' safety. The court ruled that these arguments did not give the Government the right to limit Free Expression.

The OPP, once again, believes it doesn't have to obey our courts. The OPP believes it has the authority to violate the Charter of Rights & Freedoms. Of course if the OPP has such authority then no one in Canada has any guaranteed Rights or Freedoms.

The OPP has illegally arrested four people for putting up Canadian Flags - a right guaranteed by the Supreme Court of Canada.

The OPP has proven just how quick Canadians can lose their Rights & Freedoms.
