Email to Ministry of Environment about Native Tire Fires. "I must assume, that at this point the Ministry is already in the process of penalising the Six Nations people for the tire fire in Caledonia. If not, could you please explain why not? Media Backgrounder The introduction of “reverse onus,” greater liability and the option of jail time for corporate officers and directors. The onus is put on directors and officers of a company that has spilled illegally to prove that the company took all reasonable steps to prevent the spill. Ministry officials would have the authority to impose penalties promptly after an unlawful spill occurs. Penalties are different than fines, which are imposed by the courts if a company is charged and found guilty of an environmental offence. |

| Dear **********: Thank-you for your e-mail expressing your concern over the situation in Caledonia regarding the tire fires. Please be aware that the OPP is in charge of the scene at the present and as such the MOE is deferring to them in this situation. Please note that the document you refer to in your e-mail deals with Bill 133 which passed third reading last June. This bill will deal with spills from regulated industry, principally those that are covered by the Clean Water Regulations of the Environmental Protection Act. As stated in the press release from the Ministry, “The government intends to apply environmental penalties to those facilities affected by the Municipal-Industrial Strategy for Abatement (MISA) regulations.” If you have any questions please do not hesitate to contact me.
